EPA and the Army Corps issue revised definition for Waters of the United States. This final regulation

clarifies the definition of Waters of the United States under the Clean Water Act forall regulatory programs. The regulation increases the types of waters that are jurisdictional by rule, clarifies which waters are not jurisdictional, and contains revised definitions for applying the definition, among other things. In New England and the Northeast, the revised definition will likely have a minor effect. In other parts of the country, especially the mid-West and arid West, the revised definition could have a substantial impact. Nationwide, Jurisdictional Determinations should be more straightforward and made more quickly. Expect continuing and vigorous opposition to the Rule, and a court challenge as soon as opponents can find a “good” case. See Waters of the U.S. Rule
